Information Notice Under Law No. 6698 on the Protection of Personal Data
This Information Notice has been prepared by English Explorer and Kariyer Akademi in accordance with Law No. 6698 on the Protection of Personal Data (“KVKK”), in order to inform you about the purposes for which your personal data are processed, how they are collected, the legal grounds, third parties to whom the data may be transferred, and your rights under Article 11 of the Law.
What is Personal Data?
Personal data refers to any information relating to an identified or identifiable natural person.
What is Considered Personal Data and How Is It Collected?
The confidentiality and security of your personal data are strictly protected under the relevant legislation. The following personal data are collected through the company’s electronic systems and digital communication infrastructure: identification details, employment information, educational background, financial data, contact details, and media such as photographs and videos.
What is the Purpose of Processing Personal Data?
Personal identification information belonging to our customers is collected and processed primarily for the purpose of fulfilling legal and contractual obligations in accordance with Law No. 6698 and other applicable legislation. Your personal data may be collected verbally, in writing, or electronically for the purposes stated above.
Personal Data Principles
a) Processed lawfully and fairly.
b) Accurate and, where necessary, kept up to date.
c) Collected for specified, explicit, and legitimate purposes.
ç) Relevant, limited, and proportionate to the purposes for which they are processed.
d) Retained only for as long as necessary for the purposes for which they are processed or as required by law.
Compliance with the principles mentioned above is mandatory when processing personal data.
In What Cases Can Personal Data Be Transferred?
Personal data cannot be transferred without the explicit consent of the data subject. However, under Article 8 of Law No. 6698, data may be transferred without explicit consent in the following cases:
If explicitly stipulated by law,
If the data subject is physically or legally incapable of giving consent and processing is necessary to protect their or another person’s life or physical integrity,
If processing is directly related to the establishment or performance of a contract,
If processing is necessary to fulfill the data controller’s legal obligation,
If the data has been made public by the data subject,
If processing is necessary for the establishment, exercise, or defense of a legal right,
If processing is necessary for the legitimate interests of the data controller, provided this does not violate the fundamental rights and freedoms of the data subject,
If the data subject has given explicit consent,
If stipulated by law,
If processing is necessary to protect someone’s life or physical integrity in cases of actual impossibility to obtain consent,
If the data subject has made the personal data public and it is processed in accordance with the intention of making it public,
If necessary for the establishment, exercise, or defense of a legal claim,
If processing is necessary for public health, preventive medicine, medical diagnosis, treatment and care services, or planning, management, and financing of healthcare services by persons under a confidentiality obligation or authorized institutions,
If required for fulfilling legal obligations related to employment, occupational health and safety, social security, social services, and social assistance,
If personal data is processed for legitimate purposes by foundations, associations, or other non-profit entities established for political, philosophical, religious, or trade union-related purposes, limited to their own members or persons regularly in contact with them and provided that the data is not disclosed to third parties.
What Are the Rights of Individuals Whose Personal Data Are Processed?
Under Article 11 of Law No. 6698, every individual has the right to contact the data controller and:
Learn whether their personal data is processed,
Request information if their personal data has been processed,
Learn the purpose of data processing and whether it is being used in accordance with that purpose,
Learn the third parties to whom personal data is transferred within the country or abroad,
Request the correction of incomplete or inaccurate data,
Request the deletion or destruction of personal data under the conditions set out in Article 7,
Request that third parties to whom personal data has been transferred are notified of the correction or deletion of such data,
Object to a result that is to their detriment arising from the analysis of processed data exclusively by automated systems,
Request compensation if they suffer damage due to unlawful processing of their personal data.
How Are Personal Data Deleted?
When the reasons requiring the processing of personal data no longer exist, such data is deleted, destroyed, or anonymized by us, either automatically or upon the data subject’s request, in accordance with Article 7 of Law No. 6698.
How Long Does It Take to Respond to Requests Regarding Personal Data?
Requests made by you must be submitted to the data controller in writing or by other methods to be determined by the Board. The data controller evaluates the request and responds as soon as possible and no later than thirty days, free of charge. However, if the transaction involves additional costs, a fee may be charged as determined by the Board. The data controller will accept or reject the request and inform the data subject in writing or electronically. If the request is accepted, it will be fulfilled. If the request is due to the fault of the data controller, any fee paid will be refunded to the data subject.
Your personal data are processed in accordance with the law and principles of good faith, respecting the privacy of private life and protecting your fundamental rights and freedoms. They are collected and processed by our Company in line with our legal obligations under Law No. 6698.
